As compared to other areas of the law, there are relatively few experienced Workers' Compensation attorneys (who represent injured workers). This is because Workers' Compensation law has an extremely high learning curve, very complex procedure and in many situations, counter-intuitive rules and policy. In addition, the fees paid are considered lower than in other areas of practice. Therefore, Personal Injury attorneys (who handle bodily injury claims due to the Negligence of others) will not typically handle the Workers' Compensation aspect of their client's case. And highly experienced Workers' Compensation attorneys often do not handle their client's Personal Injury case.
At Bates Law, we handle both. We are also often brought in by other counsel to handle a portion of their clients' cases. This has an enormous benefit to the client because when a client is pursuing a Personal Injury claim contemporaneously with their Workers' Compensation claim, there can be competing interests.
For example, the sum of the costs incurred for benefits paid in the Workers' Compensation claim acts as a Lien against the Personal Injury case. Then, when there is a settlement or Award in the Personal Injury case, the net recovery to the client acts as a Credit against the client's future benefits, effectively halting all further payments and benefits such as medical treatment.
There are defenses to both the Lien and the Credit which must be understood by the attorney(s). Timing becomes very important and if there is more than one attorney on the two cases, cooperation is paramount.
